Pacifism is routinely criticized as sectarian, incoherent, and preoccupied with moral purity at the expense of responsibility. The author contends that the pacifism of John Howard Yoder is vulnerable to none of these charges and defends this claim by establishing parallels between Yoder's analysis of killing and Augustine's analysis of lying. Although, within the terms of his own argument, Augustine's rejection of all lying as unjust is consistent with his condoning of some killing as just, the author shows that given (...) a different conception of the defining characteristic of God , Augustine's theological argument against lying would become an argument against violence. The author therefore suggests that Yoder's rejection of killing is no more sectarian, incoherent, or irresponsible than Augustine's rejection of lying. (shrink)

Alain Epp Weaver's analysis of the theological foundations of Augustine's proscription of all lies in all circumstances does more than improve our understanding of Augustine. In drawing a plausible and illuminating parallel between the theological logic of Augustine and the theological logic of John Howard Yoder, Weaver not only succeeds in defending the credibility of Christian pacifism but also provides support for interpreting Yoder as a biblical realist. Moreover, the divergence between Weaver and Christopher Kirwan in (...) their critical assessments of the cogency of Augustine's treatment of lying serves to throw into relief the differences between secular philosophical ethics and theological ethics, incidentally suggesting why it is often difficult for twentieth-century thinkers to understand and evaluate premodern texts. Christians have historically differed as to whether the wrongness of an act is to be located in the objective character of the act or in the intention of the agent. By blurring this distinction, Alain Epp Weaver fails to see the real principle of consistency that unites Augustine's analyses of warfare and lying. Likewise, by not appreciating the fact that Augustine analyzes the wrongness of the act in terms of intention whereas Yoder analyzes its wrongness in terms of (...) its objective character, Weaver proposes a conversation between two figures who lack the framework of shared assumptions that makes engagement in conversation possible. Uses the thoughts of such great minds as Kierkegaard, Plato, and Beckett to examine the concept of love and redefine it in the face of twenty-first century modernity.

In this article, we offer a rebuttal to a key thesis in Chapter 5 of Engelhardt’s After God: namely, that there exists an “unbridgeable gap” between the dominant secular culture and traditional religious believers. Contra Engelhardt, we argue that it is possible to bridge the gap by employing a strategy that includes, but is not limited to, methods for cultivating understanding and respect and a sense of solidarity. Our argument proceeds in three steps. First, we elucidate Engelhardt’s thesis in light (...) of some of the key concepts he discusses elsewhere in After God. Second, in the hope of developing understanding and respect, we elucidate the history and teachings that form the consciences of traditional Christian medical professionals concerning abortion, euthanasia, and disfiguring surgeries. Third, in the hope of developing a sense of solidarity, we explain the broad scope of the dominant secular culture’s attempt to limit people’s freedom of conscience rights, showing that it includes not only traditional Christians but also members of other traditional religions, members of mainline religious groups, people with alternative conceptions of secularity, and even faithful members of the dominant secular culture. Connaissons-nous l'enfant? Au sortir du " siècle de l'enfant ", la différence de l'enfance ne cesse de nous interroger. Si l'exigence de penser l'enfance à nouveau est aujourd'hui partagée, les voies de cette entreprise, et plus précisément les problématiques au sein desquelles elle s'impose, sont diverses et mouvantes, à l'image du monde dont héritent ceux que Hannah Arendt appelait " les nouveaux-venus ". Emergent toutefois du foisonnement des pensées de l'enfance quelques paradigmes que l'ouvrage se propose de rendre visibles. Le (...) paradigme démocratique inscrit la question de l'enfance dans la dynamique égalitaire des sociétés démocratiques, et dans l'inéluctable effacement de la différence enfant/adulte auquel les conduit leur " passion de l'égalité ". Le développement de la " philosophie pour enfants " relève-t-il de cette passion de l'égalité? La figure de " l'enfant philosophe " participe-t-elle de cet effacement? Assurément son émergence au cours des vingt dernières années constitue l'un des faits marquants d'une histoire commune à l'enfance et à la philosophie. Que dire alors de la figure de l'enfant artiste, de l'enfance saisie dans sa proximité avec l'artiste? Elle participe d'une tentative de penser l'enfance autrement, d'une pensée esthétique de l'enfance alliant l'héritage schillérien des Lettres sur l'éducation esthétique de l'humanité aux tentations d'une pensée poétique de l'enfance. Que devient alors, dans cette pensée de l'enfance bousculée, cette autre figure qui ne cesse d'accompagner l'enfance, du moins depuis qu'on la pense comme éducable, la figure du pédagogue? Voilà peut-être l'un des points de résistance aux bouleversements postmodernes : l'impossibilité d'une connaissance de l'enfance qui n'en passe pas par l'éducation de l'enfance. Le point de vue paradigmatique n'épuise toutefois pas la question. Par-delà les paradigmes qui tentent de la saisir, quelque chose de l'enfance ne cesse de se dérober. (shrink)

It was originally suggested that the Anthropocene began in 1784, the date of James Watt’s patent for the rotative steam engine. Patent dates are interesting artefacts. They owe their existence to the chronopoietic technique of patent jurisprudence, which generates temporal sequences out of synchronous states of knowledge. This may not be geological time, but it informs the experience of time that is proper to the culture whose deposits of Pu-239 now mark the onset of the Anthropocene. Patent jurisprudence makes a (...) crucial contribution to what might be called the ethos of the Anthropocene: the sense of society as having an inexhaustible capacity for innovation, for endless self-renewal. And, as it turns out, the steam engine yields some interesting insights into this mode of enchantment. (shrink)

It is widely acknowledged that human rights law and international criminal law share core normative features. Yet, the literature has not yet reconstructed this underlying basis in a systematic way. In this contribution, I lay down the basis of such an account. I first identify a similar tension between a “moral” and a “political” approach to the normative foundations of those norms and to the legitimate role of international courts and tribunals adjudicating those norms. With a view to bring the (...) debate forward, I then turn to the practices of HRL and international criminal law to examine which of those approaches best illuminates some salient aspects of the adjudication of ICs. Finally, I argue that the political approach best explains the practice. While each preserves a distinct role, HRL and ICL both establish the basic conditions for the primary subject of international law, namely the state, to legitimately govern its own subjects constructed as free and equal moral agents. Braudel estime que sa distinction entre trois durées historiques devrait offrir un cadre épistémologique et méthodologique commun aux sciences sociales, sociologie comprise. La typologie des temps sociaux de Gurvitch ne lui semble pas opératoire : elle est trop qualitative. Gurvitch lui répond que réalité et temps historiques se rapportent à des genres particuliers de temps sociaux, qualitatifs-quantitatifs, discontinus-continus... L’étude de (...) ces derniers confirmerait que l’historien et le sociologue ne peuvent concevoir de la même manière leur objet et leur méthode. Esquisse d’une analyse critique.The recurrent debate between Braudel and Gurvitch was given a new development in 1958, when both of them clarified their definition of time. In Braudel’s mind the distinction he made between three different historical times offered a common epistemological and methodological framework for social sciences, including sociology. For Braudel, Gurvitch’s typification of time in terms of social times seemed to be unoperative : it is too qualitative. Gurvitch replied to him that historical reality and historical times referred to specific types of social times : qualitative-quantitative, discontinuous-continuous... The study of these types would confirm that the historian and the sociologist do not conceive their object and their method in the same way. The article sketches a critical analysis of the question. We study the Full Bayesian Updating rule for convex capacities. Following a route suggested by Jaffray (IEEE Transactions on Systems, Man and Cybernetics 22(5):1144–1152, 1992), we define some properties one may want to impose on the updating process, and identify the classes of (convex and strictly positive) capacities that satisfy these properties for the Full Bayesian Updating rule. This allows us to characterize two parametric families of convex capacities: ${(\varepsilon,\delta)}$ -contaminations (which were introduced, in a slightly different form, by Huber (...) (Robust Statistics, Wiley, New York, 1981)) and ${\varepsilon}$ -contaminations. (shrink)

Choquet integrals and capacities play a crucial role in modern decision theory. Comonotony is a central concept for these theories because the main property of a Choquet integral is its additivity for comonotone functions. We consider a Choquet integral representation of preferences showing uncertainty aversion (pessimism) and propose axioms on time consistency which yield a candidate for conditional Choquet integrals. An other axiom characterizes the role of comonotony in the use of information. We obtain two conditioning rules for capacities which (...) amount to the well-known Bayes' and Dempster–Schafer's updating rules. We are allowed to interpret both of them as a lack of confidence in information in a dynamic extension of pessimism. (shrink)

Les études modernes sur les jeux de hasard et d’argent dans le monde romain se concentrent principalement sur les joueurs masculins de l’élite, mais les sources écrites et iconographiques fournissent de nombreuses preuves de la présence de joueuses de tous horizons. Cette contribution rassemble les témoignages textuels et iconographiques qui, jusqu’à présent, ont été largement négligés quant aux informations qu’ils peuvent fournir sur les femmes et le jeu dans l’Antiquité romaine. Elle explore la relation entre le jeu et le féminin, (...) des déesses aux grands-mères, et met en lumière les implications sociales du jeu et des paris pour les joueuses. Le jeu féminin était très répandu et pouvait prendre des formes différentes dans des contextes variés. En analysant ces textes ensemble pour la première fois, nous pouvons saisir de manière plus riche et nuancée l’importance du jeu au féminin à Rome en révisant les modèles existants trop dépendants de quelques textes célèbres. Résumé Le principe de précaution a été introduit dans la Constitution de la V e République par une révision constitutionnelle du 1 er mars 2005. La constitutionnalisation de ce principe conduit à se demander ce qu’une constitution doit contenir. La question est en particulier de savoir si une constitution doit énoncer un droit fondamental à la protection de l’environnement. Si l’on comprend la constitution dans un sens libéral, c’est-à-dire comme un texte fondamental qui sépare les pouvoirs et qui protège les (...) libertés, l’insertion du principe de précaution dans la constitution est discutable. Le présent article étudie également les conséquences de la révision de 2005 sur l’évolution du droit français dans différents domaines. (shrink)

While this article by Waldman and Newberg is correct in its main message, it is unfortunately fraught with inaccuracies and problems. To illustrate: (1) the statement that “Inner speech is also associated with lower levels of psychological distress” is invalid as a wide array of distressing psychological disorders are associated with distorted (e.g., ruminative) inner speech activity.
